Terms of Service

These terms are an agreement between you and Jellicomb LLC, a North Carolina limited liability company (“Jellicomb,” “we,” “us”). They cover this website and the software applications we publish for iPhone, iPad, and Mac (together, the “Services”). By using the Services, you agree to these terms. If you do not agree, please do not use them.

Using the Services

You may use the Services for lawful purposes only. You agree not to misuse them — for example, by interfering with their normal operation, attempting to gain unauthorized access to systems or accounts, reverse engineering our software except where that right cannot be limited by law, or using the Services to violate anyone’s rights.

If you obtained one of our apps through the Apple App Store, your use is also subject to Apple’s terms, and Apple’s standard end user license agreement applies in addition to these terms. Where the two conflict as to app usage rules, Apple’s licensed application terms control for that app.

Your license

Subject to these terms, we grant you a personal, non-exclusive, non-transferable, revocable license to use our apps on devices you own or control. We retain all rights in the Services, including the software, designs, text, graphics, and the Jellicomb name and marks. Nothing here transfers ownership to you.

Purchases and subscriptions

Some apps or features may be sold as one-time purchases or subscriptions. Where those are purchased through the App Store, Apple handles billing, renewals, and refunds under its own policies; we do not process or store your payment details. Prices and features may change going forward, and any change applies only after it takes effect.

Your content

You keep ownership of any content you create with our apps. You are responsible for that content and for keeping your own backups. We claim no rights in it beyond what is needed to operate the Services for you.

No warranty

The Services are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, secure, or that any defect will be corrected. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.

Limitation of liability

To the fullest extent permitted by law, Jellicomb LLC and its members, officers, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or business interruption, arising out of or relating to the Services — even if we have been advised such damages are possible.

Our total liability for any claim relating to the Services is limited to the greater of the amount you paid us (or paid for the app in question) in the twelve months before the claim arose, or twenty-five U.S. dollars. Some jurisdictions do not allow these limits, so they may not fully apply to you.

Termination

You may stop using the Services at any time by deleting our apps. We may suspend or end your access if you materially breach these terms or if we discontinue a product. Sections that by their nature should survive — ownership, disclaimers, limitation of liability, and governing law — survive termination.

Changes to these terms

We may update these terms from time to time. When we do, we will revise the effective date above and post the current version on this page. Material changes will be reflected here before they take effect where practical. Your continued use of the Services after a change means you accept the updated terms.

Governing law

These terms are governed by the laws of the State of North Carolina, without regard to its conflict of laws rules. You and Jellicomb agree that the exclusive venue for any dispute that is not otherwise resolved will be the state or federal courts located in North Carolina, and each of us consents to their jurisdiction.
